(BOSTON, Mass.)- Today, a broad coalition of consumer, civil rights, labor, and community organizations issued a letter strongly urging members of the U.S. House of Representatives to support of H.R. 5282, the Comprehensive Consumer Credit Reporting Reform Act of 2016, introduced today by Congresswoman Maxine Waters.
Over the last decade, an increasing number of cities and states passed laws limiting the use of credit checks in hiring, promotion, and firing. These laws have been motivated by the reality that personal credit history is not relevant to employment and that employment credit checks prevent otherwise qualified workers with flawed credit from finding jobs, and that unemployed workers and historically disadvantaged groups, including people of color, are disproportionately harmed by credit checks.
Consumer advocacy groups have long complained that there is no link between bad credit and job performance. They argue that such checks lead to discriminatory hiring.
The system is profitable but imperfect, and for decades critics have attacked it for all sorts of offenses. In 1969, Columbia University legal scholar Alan Westin testified to Congress that the companies violated Americans’ right to privacy and that their inaccuracies damaged lives.
Millennials have an average credit score of 625 (based on the Experian VantageScore 3.0 credit score), compared to 650 for Generation X and 709 for those over 50 years old. They also use an average of 43 percent of their credit limits—compared to 34 percent nationally—and their average debt (excluding mortgages) totals 77 percent of their income, compared to 49 percent nationally.
While income is distributed unequally in the country, what few people know is how much more unequally wealth, financial assets and inheritances are distributed.
The rationale behind the ban is simple: it’s unfair and useless to use a person’s credit history, which is often inaccurate or misleading, when assessing their job qualifications.
"You are in a Catch-22," said Emmanuel Caicedo, a senior campaign strategist with Demos, one member of a coalition of 79 labor and civil rights organizations that formed the NYC Coalition to Stop Credit Checks in Employment.
"You can't pay your bills and so your credit is bad. And then you can't get a job to pay your bills because of your credit."
Life happens. We have children to support. We lose jobs. Marriages fall apart. By the time we near our ‘Golden Years’ the nest-egg we may have envisioned may be a lot smaller than we thought and in many cases, not there at all due to heavy debt loads.
Maybe no economic statistic captures the continuing impact of the nation’s history of inequality better than the racial wealth gap. It has left a yawning gulf that separates whites from blacks and Hispanics. And it persists across income and educational levels in ways that have left whites who are high school dropouts with a higher median new worth greater than blacks and Hispanics who are college graduates.
For companies hiring staff, pitches from online security firms sound appealing enough: Running a credit check before signing up a new employee will “offer insight into an applicant’s reliability and a sense of their personal responsibility,” insists employeescreen.com.
Another security firm swears employers using credit checks will “find out what you need to know.”
Nearly half of the nation's employers investigate job applicants' credit histories as a condition of employment.
As a result, New Yorkers struggling with debt -- medical bills, school loans or car payments -- are often shut out of jobs. This unfair barrier to employment can be dismantled by outlawing employment credit checks.
Democratic Council Members Brad Lander of Brooklyn and Debi Rose of Staten Island have introduced a bill that would ban such checks in hiring except when required by state or federal laws. The measure is supported by 40 council members.
(New York, New York) – Today the national public policy organization Demos and The National Council of La Raza (NCLR) released a new report that explores the use of credit cards and the impact of debt on Latino households in America.
The housing crash resulted in a tremendous loss of wealth in the Latino community. Households have fewer resources to draw on in times of need.
The FDIC estimates there are 10 million people living in the U.S. who do not have a bank account — that’s one out of every 13 households. Nearly 33 percent of people living in Starr County, TX can’t write a check. In one census district in Savannah, GA, over 42 percent of residents are unbanked. The unbanked are usually poor, often minorities, and find themselves shunned by banks that can’t make money off them. Typically, they end up turning to predatory check cashers and payday lenders. Many also feel a great sense of social division between themselves and those who have bank accounts.
By offering low-fee checking accounts, Walmart dares to go where most big banks won't. Few major financial institutions are willing to give lower-income Americans checking accounts these days -- without exorbitant fees.
But, unlike the big banks, Walmart really needs low-income customers.
